Premises Liability: NC vs. SC

In North Carolina, the doctrine of contributory negligence is followed. Contributory negligence says a plaintiff may not recover damages if even partially at fault for the incident. North Carolina is one of four states that still follow this rule. There are exceptions to this rule such as children under the age of seven, cognitive impairment, gross negligence, and last clear chance.

 

In South Carolina, if a plaintiff is less than 50% at fault for the injury, they may file a claim to receive compensation. South Carolina follows the doctrine of comparative negligence, allowing the plaintiff to still get compensation even if they shared an amount of fault. It is important that their fault is no greater than the negligence of the other party.
